Per figures released by Israel, no fewer than 98 detainees from Palestine have perished while detained since October 2023. A human rights group located in Israel has indicated that the real figure is likely significantly greater, due to many of missing people originating in Gaza.

Investigation Outcomes

A new investigation documented deaths attributed to physical violence, lack of healthcare, and malnutrition. Researchers employed official data requests, medical examiner documents, and interviews with lawyers, human rights defenders, family members, and eyewitnesses.

Israeli authorities released detailed statistics only for the opening period of the conflict. During this time, official figures indicate an unprecedented casualty rate among detained Palestinians, equating to a life lost each 96 hours.

Updated Statistics

Official armed forces last updated information on deaths in detention for May 2024, and the prison service during September 2024. Researchers documented an additional 35 casualties in confinement after these timeframes and verified them with official sources.

Even with the total number of deaths documented being substantially larger than previous assessments, it likely does not reflect the entire scope of Palestinian loss, according to the head of the prisoners and detainees department.

“While we are providing evidence for a higher number of deaths than earlier indicated, this is not the entire story,” he said. “We are certain that there are even now individuals who died in confinement that we are unaware of.”

Civilian Deaths

Classified Israeli data indicates that the vast majority of Palestinian prisoners from Gaza who died in prison were non-combatants, based on a parallel examination.

During May of 2024, a military intelligence database tracking all combatants in Gaza, a roster of over 47,000 listed people, documented just 21 casualties in detention. By that date, 65 Palestinians from Gaza had died in detention.

Prison Situation

Brutality, torture, and further cruelty of detainees from Palestine has become routine across Israel’s jail system over two years of conflict. High-ranking authorities have publicly referenced minimal sustenance and an underground jail confining Palestinian individuals who are kept in darkness.

Existing and previous inmates and informants from the defense forces have uniformly asserted systemic violations of international law.

Organized Maltreatment

The organized mistreatment came with a troubling surge in deaths recorded across no fewer than 12 prison sites in Israel. In the decade prior to the conflict, there were typically a couple fatalities a year.

“This isn’t only a single occurrence sporadically. It is institutional and it is likely to persist,” a spokesperson said, in part because there is a culture of near total impunity for killing and mistreating detainees.

Merely one incident of assaulting detainees has come to trial, with the military personnel sentenced to 210 days. An effort to prosecute others over a vicious assault featuring sexual violence caused right-wing protests and the arrest of Israel’s top military lawyer, with the alleged perpetrators now requesting that charges against them are dropped.

Absence of Consequences

“In spite of this significant total of fatalities, over two years not a single person has faced arrest,” the spokesperson said. “There exist no indictments over any killing.

“As long as these measures remain in effect, each Palestinian individual in confinement faces risk, also the healthy ones, even the juveniles who have no medical issues.”

Notable Incidents

Some deaths in confinement have been widely reported, including a senior medical chief who perished in prison after four months in detention.

An inmate held with the victim stated that he was led to the yard by prison staff shortly before his passing, clearly wounded and naked from the waist down. His corpse has not been repatriated to Gaza.

Additional detainees who lost their lives in Israeli custody stay unnamed. Detention administrators and defense forces gave investigators with the total of casualties in detention, and basic other details including the facility where they lost their lives, but not the inmates’ personal details.

Recognition Difficulties

For 21 instances, mostly people from Gaza, investigators were unable to correlate the limited information supplied by authorities to a casualty recorded by rights organisations, via accounts from released detainees or coverage in the media.

The detainees’ families might not have learned about their relatives’ casualties either, as Israel has impeded efforts to locate detainees it is confining. During 210 days at the start of the hostilities, the Israeli military refused to supply essential data about the whereabouts of thousands of people held in Gaza, in effect carrying out a practice of forced disappearance, according to the human rights group.
