US Judge Orders Freedom of Kilmar Abrego Garcia from Immigration Detention

A court has ruled the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement lacks legal authority.

"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her ruling.

The situation stems from a mistaken deportation to El Salvador in March, which the government later acknowledged was an error. Following his return to the United States to face human smuggling allegations, he was held in federal custody.

In her order, the judge noted that the government lacks a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "for now."

Context of the Case

The court challenge center on conflicting claims. While the former administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this allegation.

He has also pleaded not guilty to the smuggling counts, which are part of a ongoing criminal case in the state of Tennessee.

The court, who was overseeing his challenge to removal in a Maryland district court, determined that he must now comply with the conditions of his release from custody in Tennessee. This decision effectively transfers his monitoring to the Tennessee court.
